Purposes and legal bases for the processing of personal data

The purpose of the processing is to fulfil the public tasks assigned to us by the legislator, in particular to inform the public.

Unless stated otherwise, the legal basis for the processing of your data results from Article 4 (1) of the Bavarian Data Protection Act (BayDSG) in conjunction with Article 6 (1) (e) of the General Data Protection Regulation (GDPR). Accordingly, we are allowed to process the data necessary to fulfil a given task.

Insofar as you have consented to processing, the data processing is based on Art. 6 (1) (a) GDPR.

If necessary, your data will be transmitted to the relevant supervisory and auditing authorities for the purpose of exercising the respective control rights.

To ward off threats to security in information technology, electronic transmission of data can be forwarded to the State Office for Security in Information Technology (Landesamt für Sicherheit in der Informationstechnik) and processed there on the basis of Art. 12 et seq. of the Bavarian E-Government Act.

Duration of storage of personal data

Your data will only be stored for as long as is necessary to fulfil the task while observing legal retention periods.

Your rights

With regards to your personal data processed by us, you as the data subject have the following rights:

  • If your personal data is processed, you have the right to obtain information about the data stored about you (Art. 15 GDPR).
  • If inaccurate personal data is processed, you have the right to have it corrected (Art. 16 GDPR).
  • If the legal prerequisites exist, you can request the deletion or limitation of processing (Articles 17, 18 and 21 GDPR).
  • You have the right to object at any time to the processing of personal data concerning you for reasons that arise from your particular situation (Art. 21 GDPR).
  • If you have consented to the processing or a data-processing contract and the data processing is carried out using automated procedures, you may be entitled to data transferability (Article 20 GDPR).
  • If you have consented to the processing and the processing is based on this consent, you can revoke the consent at any time for the future. The legality of the data processing carried out on the basis of the consent until the revocation is not affected by this.

Technical implemantation

Our web server is operated by the State Office for Digitization, Broadband and Surveying – IT-Service Centre of the Free State of Bavaria. Logging

When you access these or other websites, you transmit data to our web server via your Internet browser. The following data is recorded during an ongoing connection for communication between your Internet browser and our web Server:

  • Access date and time
  • Name of the accessed file
  • Page from which the file was accessed
  • Access status (transfer file, file not found, etc.)

For reasons of technical security, in particular to ward off possible attacks on our web server, this data is stored by us. After seven days at the latest, the data is anonymised by shortening the IP address at the domain level, so that it is no longer possible to relate it to individual users.

To ward off threats to security in information technology, the data is forwarded to the State Office for Security in Information Technology and processed there on the basis of Art. 12 et seq. of the Bavarian E-Government Act.

Web Tracking Systems

Notes on using e-mail

Information sent in an unencrypted e-mail by you to us might be read by third parties during the transmission process. Generally, we do not have the possibility to check your identity, and do not know who conceals behind an e-mail address. For this reason, legally secure communication is not ensured when communicating by e-mail. Like many e-mail providers, we implement filters against unsolicited advertising (spam filters) which erroneously, though seldom, classify normal e-mails automatically as unsolicited advertising and delete them. In any case, e-mails containing harmful programs (“viruses”) are automatically deleted by us.

If you wish to send us messages that require protection, we recommend encrypting and signing them in order to prevent unauthorized disclosure and falsification in the transmission route or to send the message to us by conventional mail.

You can send PGP-encrypted e-mails to us at the following e-mail address: poststelle (at) stmbw.bayern.de. You can call up the required PGP communication key (public key) from the central PGP key server of the Bavarian Government Network under the address “pgp-keyserver.bayern.de”. Information about the encryption software “GpG4Win”, which was developed for free by the Federal Office for Information Security, is available on the website http://www.gpg4win.de/. The establishment of PGP for communication with the Bavarian administration is described in more detail in the brochure (PDF) available there.

Please also let us know if and how we can send you encrypted emails to answer your submissions. If you have no way to receive encrypted e-mails, we ask you to give us your postal address in order to reply to your protection-worthy messages.
